My bank unjustly took my money and I have a plan to get it back will the bank have legal recourse if i do this?

Yes, They can sue you for the overdraft amount, court costs and penalties. If they will not work with you further, you need to try and call the main office for that bank and try again. If no luck, you may just be out of that money. Definitely switch banks.
